Your privacy is very important to PokerStars, Full Tilt, BetStars and PokerStars Casino, all of which are brands owned and controlled by a group of companies known as the “Rational Group”, the owner and operator of the websites located at www.pokerstars.eu, www.pokerstarscasino.eu, www.betstars.eu and www.fulltilt.eu (the “Sites”).
Where used and the context allows, the term “Group” means Rational Gaming Europe Limited together with its subsidiaries and any holding company of Rational Gaming Europe Limited and any subsidiary of such holding company and any company associated with the group of companies known as Rational Group (herein collectively referred to as “Rational Gaming”, “Group” “we” or “us”).
What information is collected and for what purpose
- to confirm financial transactions,
- to provide the Services to you;
- identification, verification and vetting purposes;
- statistical analysis and research;
- research and development;
- marketing, market research and customer profiling;
- data analysis;
- to comply with licensing and regulatory requirements;
- to analyse your credit and fraud risk;
- to combat against security risks; and
- to confirm your geographic location
We may disclose your personal information:
- if required to do so by law or by regulatory authority;
- if we believe in good faith that such action is necessary:
- to comply with any law or comply with any legal process served on us;
- to protect and defend our rights or property;
- to comply with any regulatory body or licensing body or authority;
- to enable third parties that provide services to us to settle or make payments in connection with any wager made by a User;
- to enable any payment management or debt collection company engaged by us to handle payment and collection processes to and from Users;
- to assist third parties who provide services to us or on our behalf;
- for the purposes of any third party that purchases us or our business or any part of us or our business;
- to assist credit reference agencies as described in the circumstances described below in this Section 2;
- with your consent;
- for the purposes of disaster recovery; or
- as set out in Sections 5 and 6 below.
We may occasionally send you details of future events, news information about a range of our products, promotional links and other marketing communications regarding the services that we offer (including general customer support services). If you no longer wish to receive such promotional notifications, you may opt-out of receiving them by following the instructions given when you receive such messages.
Where you fail to reimburse us for any chargebacks, denial or reversal of deposits you make, we may, subject to applicable law, give details of your accounts and how you manage them to credit reference agencies or the equivalent of the same in the jurisdiction where you reside (“CRA”). Please note that the CRA may record the outstanding debt owed against your name and other personal details and this information may be supplied to other organisations. Such records will remain on the CRA file for 6 (six) years or such other period as made applicable, after the date of the chargeback, denial or reversal of payment. The information will be used by the CRA to prevent crime, fraud, money laundering, verifying your identity if you, your partner, other members of your household, your business or financial associates apply for other credit facilities using your name or details, monitoring the operation of accounts you may hold, making decisions for credit, credit related or other facilities, trace your whereabouts, recover debts that you owe, statistical analysis and system testing.
Your personal information may be processed by us, our affiliates, our agents and third parties providing services to us, in jurisdictions outside of the European Economic Area. In this event we will comply with the terms of the Data Protection Act 2001 under the Laws of Malta in relation to the transfer of such personal information.
We will only use your name in publicity materials with your consent.
The name you register with us to open a Stars Account must be your own name. In addition, it is very important that you complete the Stars Account registration form with valid and up to date information, since it will be used in the course of validating financial transactions and the other aforementioned purposes. You are required to advise us of any relevant changes to your personal information.
Users are able to change account details by selecting the relevant account option in the downloaded software.
Deposit and withdrawal processing
In the course of making a deposit, Users will need to provide deposit method information (example: credit card number and other credit card details). This information in conjunction with your other personal information might be used to clear financial transactions executed by you with Rational Gaming. You are required to advise us of, or update on your Stars Account, any relevant changes to your personal information.
You should also do your part in protecting your information. Your Login Credentials (as defined in our End User Licence Agreement) are confidential and you are obliged to keep your Login Credentials secret and confidential at all times and to use your best efforts to protect their secrecy and confidentiality.
Please note that, if you use our Home Games service, your User Account Stars ID will also be your Club Manager or Member identifier, and will be displayed to the Club Manager and Members in the Home Games lobby, Club lobby and (if the Club Manager opts-in for inclusion in directories) public directories of Clubs. Thus, people who know you through Home Games and/or your Club will also know the identity of your Stars ID. If you do not agree to this, you must not use Home Games.
Limits of Confidentiality
Legally Required Disclosures: Due to the legal, regulatory and security environment in which we operate, we may be required, under certain circumstances, to disclose personally identifiable information about our Users and we may not be permitted to inform you that we have done so. We will use reasonable endeavours to limit such disclosure to the following:
- where we believe in good faith that we are required to do so in response to a subpoena, warrant or other legal process; or
- where reasonably necessary to identify, contact or bring legal action against persons or entities to preserve and/or enforce our rights; or
- where necessary to aid the prevention of match or price rigging on our BetStars site or to identify anomalous betting patterns as part of an early warning system, we may relay information relating to such betting patterns or a suspected offender’s details to sporting bodies, regulatory authorities or any other third party organisations that we are a member of which deal with the investigation of such offences.
Further, we can, and you authorize us to, disclose your Stars ID, name, age, street address, city, state, post code, country, phone number, e-mail, geo-location plus details of financial instruments used to deposit and withdraw to our third party agents or official government bodies as we, in our sole discretion, believe necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy or other unlawful activity or activity that may expose us to legal liability.
Who receives your information?
We may use your email address and phone number for the purpose of providing you with news, promotions and other marketing offers from the Group. We may also share your email address and phone number with our marketing partners for the purpose of providing you with other marketing offers. Out of respect for your right to privacy we have provided you with an easy means by which you may stop receiving marketing offers via email and telephone from us or from our partners and affiliates. You may request at any time to no longer receive such offers by sending us a blank message with the word "Remove" in the subject area to Events. If you request to stop receiving marketing communications about these offers, we will remove your details from our marketing distribution lists and from any future lists we may share with our marketing partners. However, you may need to unsubscribe separately from marketing offers sent by partners who have received your contact details from us prior to your request to be removed from these lists.
Your rights in relation to your information
You have a right to ask us to supply you with a record of the personal information that we hold about you (in accordance with applicable legislation). This is known as a subject access request (SAR) and provided that we are satisfied as to your identity to our reasonable satisfaction (which can take the form of our request for and your submission of such identification and other information as we may request from you), we have forty (40) days to comply with your SAR. We may, in certain circumstances, levy a small charge to cover the administration of your SAR, the cost of which will be in accordance with applicable law. We aim to keep our information about you as accurate as possible. You can write to us at any time to review, change, or have your details altered or corrected in accordance with your rights under the Data Protection Act 2001 under the Laws of Malta and in this event we will also require evidence of your identity. In order to contact us regarding your information please e-mail Support. Please note that if we close or if you request us to close your Stars Account for any reason, your personal details will be retained for such period as may be required under applicable anti-money laundering regulations or other licence requirements.
